1. Introduction

Thank you for using Price Tag FX. By downloading, installing, accessing, or using the Price Tag FX mobile application and related services provided by emonster, inc. (collectively, the "Services"), you agree to these Terms of Use ("Terms").

If you do not agree to these Terms, do not use the Services.

emonster, inc. ("emonster", "we", "our", or "us") may update these Terms from time to time. Continued use of the Services after an update means you accept the revised Terms.

2. About Price Tag FX

Price Tag FX helps travelers and shoppers point an iPhone at a retail price tag, shelf label, or sale tag to detect visible prices, translate limited price-label meaning, and estimate conversion into a selected currency.

Price Tag FX is not a general translation service, financial product, payment service, banking service, tax service, or shopping agent.

3. License and Permitted Use

Subject to your compliance with these Terms, emonster grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the App for your personal, non-commercial use on an iPhone that you own or control.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, or attempt to derive source code from the App except to the extent expressly permitted by applicable law.

4. Eligibility

You must be at least thirteen (13) years old, or the minimum age required in your jurisdiction, whichever is greater, to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian.

5. Camera, OCR, and Translation Results

Price Tag FX depends on camera quality, lighting, focus, label design, OCR recognition, local dictionaries, parsing logic, and supported languages. Results may be incomplete, delayed, inaccurate, or unavailable.

Price Tag FX may misread prices, currencies, discounts, member-only prices, tax-included labels, tax-excluded labels, unit prices, or other retail text. You are responsible for confirming the actual price, tax, discount, membership condition, and checkout amount with the store or seller.

6. Currency Conversion and Exchange Rates

Currency conversions in Price Tag FX are approximate. Rates may be delayed, cached, unavailable, rounded, or different from rates used by card issuers, banks, payment processors, stores, or currency exchange providers.

Price Tag FX may obtain exchange-rate data from Frankfurter or another configured exchange-rate provider. We do not control third-party exchange-rate providers and do not guarantee the accuracy, availability, timeliness, or completeness of any rate data.

Price Tag FX does not provide financial, investment, tax, accounting, legal, or currency-exchange advice. Do not rely on Price Tag FX as the sole basis for purchases, transactions, travel budgets, tax decisions, or financial decisions.

7. Offline and Cached Data

Price Tag FX can use cached exchange-rate snapshots for offline conversion after rates have been downloaded. Cached rates may become outdated. The App may show rate freshness, but you remain responsible for deciding whether a cached or approximate conversion is acceptable for your use.

8. Privacy

Your use of the Services is also governed by our Privacy Policy. Price Tag FX is designed to process camera frames and OCR on the device, without cloud OCR, cloud translation, advertising SDKs, accounts, or app-created scan history in the current version. The Services may use Firebase Analytics and Firebase Crashlytics for app analytics, crash reporting, non-fatal error diagnostics, and reliability monitoring as described in the Privacy Policy.

9. No Emergency, Safety, or Professional Use

Price Tag FX is a convenience utility. It is not designed for emergency, safety-critical, regulated, professional, or high-stakes use. You should not use the Services where an inaccurate OCR result, translation, price interpretation, or currency conversion could cause significant harm.

10. Prohibited Uses

You agree that you will not:

  • Use the Services for any illegal purpose or in violation of applicable law;
  • Interfere with, disrupt, or attempt to compromise the Services;
  • Use the Services to infringe the rights of emonster or any third party;
  • Use automated means to access, scrape, copy, or abuse the Services;
  • Remove, alter, or obscure copyright, trademark, or proprietary notices;
  • Misrepresent Price Tag FX results as guaranteed, official, or provided by a store, bank, card issuer, or government.

11. Intellectual Property

Price Tag FX, the Price Tag FX application icon, product screenshots, user interface, software, text, graphics, branding, and related assets are owned by emonster or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly stated in these Terms.

12. Third-Party Services and Content

The Services may use or link to third-party services, content, data, frameworks, or websites, including Apple services, Firebase / Google services, and exchange-rate providers. Third parties operate independently and may have their own terms and privacy policies. We are not responsible for third-party content, data, availability, policies, or practices.

13. Changes to the Services

We may modify, update, suspend, or discontinue the Services or any part of them at any time, with or without notice. We are not obligated to provide maintenance, support, updates, or continued availability except to the extent required by applicable law.

14. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.

EMONSTER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, OR AVAILABLE AT ALL TIMES.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMONSTER'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO EMONSTER FOR THE SERVICES DURING THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to indemnify, defend, and hold harmless emonster and its affiliates, officers, employees, agents, partners, and licensors from claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of applicable law or third-party rights.

17. Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination will survive.

18. Governing Law and Venue

These Terms and your relationship with emonster are governed by the laws of the State of Washington, U.S.A., without regard to conflict-of-law principles. You agree that legal proceedings relating to these Terms or the Services will be brought exclusively in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.

19. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. These Terms, together with the Privacy Policy and any applicable App Store terms, form the agreement between you and emonster for the Services.
